Understanding Direct Appeals

Every person who is convicted of a crime can choose to appeal the case. The court in which you will file this appeal depends on where your case was tried. If your case was tried in state court, your appeal will be filed in the court of appeals for that state. If your case was tried in federal court, you must file your appeal with the Circuit Court of Appeals in your region. 


A direct appeal usually involves submitting a written brief to the correct court. This brief will detail the reasons for your appeal. In most cases, the court will make a decision based on this information alone. However, some cases may involve oral arguments from the prosecution and defense.
